Client and officer engaged in a 41 minute recorded conversation prior to entering the elevator to proceed up to the officer's room. When client stepped off the elevator, he was immediately arrested for agreeing to sex for a fee. Despite the State having a 41 minute recorded conversation, Skinner challenged the State's ability to prove an actual agreement to have sex for money had occurred. Although the undercover officer had discussed sex for money repeatedly, Client never agreed aloud to pay a fee for sex. When Skinner and client refused a plea agreement and asked the Court to set the case for trial, the State dismissed the case.

The POM misdemeanor was being leveraged to revoke client's parole and possibly send client to prison for a significant number of years. The accusations and arrest were made by a drug task force officer who essentially profiled our client as a drug dealer because he was African American and wearing an all red-colored outfit. Client maintained his innocence throughout the entire process. After visiting the scene of the arrest and photographing the location we were able to convince the Prosecutor the Police Officer humanly could NOT have observed what he alleged to observe.

In closing arguments, Billy Skinner asked the jury to focus on the jury charge from the Judge, ignore the "smoke" the government had presented of client's past and focus on the testimony regarding this specific allegation. BS challenged the Jury to weigh the conflicting testimony of the complaining witness and the two police officers against the testimony of our client.
