Elements of the Offense

In order to obtain a conviction, the prosecution must demonstrate the following facts:

• The defendant was 17 years old or older at the time of the offense
• The victim was a child, less than 14 years old

Texas law defines an "act of sexual abuse" as any of these crimes:

• Indecency with a child (§21.11(a)(1)), depending on the circumstances of the act
• Sexual performance by a child, defined in § Section 43.25
• Compelling prostitution, defined by § Section 43.05(a)(2)
• Trafficking of persons (under § 20A.02(a)(7) or (8))
• Sexual assault as defined in § 22.011
• Burglary with the intent to commit a sex crime, listed in § Section 30.02
• Aggravated kidnapping (under § 20.04(a)(4), and only if the defendant intended sexually abuse the victim

What are the penalties for continuous sexual assault of a child?

As a first-degree felony, continuous sexual abuse of a child or children is punishable by imprisonment for life. If the defendant is not given a life sentence, he / she will face imprisonment for no less than 25 years and no more than 99 years.
